Welcome to ThunderBird Media. These Terms of Service ("Terms") govern your access to and use of the ThunderBird Media website, storefront, and digital products (collectively, the "Services"). By using the Services or completing a purchase, you agree to these Terms. If you do not agree, please do not use the Services.

1. Who We Are

ThunderBird Media is an aerial photography and digital-media business based in Keshena, Wisconsin, United States. Contact: cwilber79@gmail.com.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to make a purchase. By purchasing, you represent that you meet this requirement and that the payment information you provide is accurate and belongs to you.

3. Products and Services

ThunderBird Media sells digital downloads only, including aerial photographs, videos, and related media files. All products are delivered electronically. We do not ship physical goods.

Product descriptions, file formats, resolutions, and preview images are provided in good faith. Colors and detail may appear slightly different on your device than in the original file.

4. Orders and Payment

- All prices are listed in U.S. Dollars (USD) and do not include applicable taxes, which will be calculated at checkout where required.
- Payment is processed securely through Shopify Payments and third-party payment providers. We do not store your full payment card information.
- We reserve the right to refuse or cancel any order at our discretion, including for suspected fraud, pricing errors, or violation of these Terms. If we cancel your order, we will refund any amount charged.

5. Delivery

Digital files are delivered via a secure download link sent to the email address you provide at checkout. Delivery is typically instant. Download links remain valid for 30 days from purchase and may be used up to 3 times. See our Shipping Policy for full delivery details.

6. Refunds

All digital sales are final. Refunds are issued only in the limited circumstances described in our Refund Policy (corrupted files, wrong file delivered, expired link, or duplicate charge), when reported within 7 days of purchase.

7. License and Intellectual Property

All Media sold or displayed on this site is the exclusive property of ThunderBird Media and is protected by copyright, trademark, and other intellectual property laws.

Your purchase grants you a non-exclusive, non-transferable, personal-use license only. Commercial use, resale, redistribution, sublicensing, AI/ML training, NFT minting, and print-on-demand use are prohibited without a separate written license. 8. Acceptable Use

You agree not to:

- Copy, resell, redistribute, or share any Media purchased from ThunderBird Media
- Use the Services to violate any law or third party's rights
- Attempt to gain unauthorized access to the site, other user accounts, or our systems
- Interfere with, disrupt, or overload the Services
- Use bots, scrapers, or automated tools to access, download, or copy content
- Remove, alter, or obscure any copyright notice, watermark, or attribution

Violation of this section may result in cancellation of your order, revocation of your license, and legal action.

9. User Accounts

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at cwilber79@gmail.com if you suspect unauthorized access.

The Services rely on third-party providers, including Shopify (hosting and checkout), payment processors, and email delivery services. Their use of your data is governed by their own privacy policies and terms. ThunderBird Media is not responsible for the acts, omissions, or content of third parties.

11. Disclaimer of Warranties

The Services and all Media are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability. We do not guarantee that the Services will be error-free, secure, or continuously available.

12. Limitation of Liability

To the maximum extent permitted by law, ThunderBird Media, its owners, employees, and affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising out of or related to your use of the Services or any Media, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from or related to the Services shall not exceed the amount you paid to ThunderBird Media in the twelve (12) months preceding the claim, or one hundred U.S. dollars ($100), whichever is greater.

13. Indemnification

You agree to indemnify and hold harmless ThunderBird Media, its owners, employees, and affiliates from any claim, demand, loss, or damage, including reasonable attorneys' fees, arising out of your use of the Services, your violation of these Terms, or your violation of any third party's rights.

14. Modifications to the Services and Terms

We may modify, suspend, or discontinue any portion of the Services at any time without notice. We may also update these Terms at any time by posting the revised version on this page and updating the "Last updated" date. Continued use of the Services after changes constitutes acceptance of the revised Terms.

15. Termination

We may suspend or terminate your access to the Services at any time, with or without cause or notice, including for violation of these Terms. Sections that by their nature should survive termination (including licensing, disclaimers, limitation of liability, indemnification, and governing law) will survive.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Wisconsin, United States, without regard to conflict-of-law principles. These Terms are governed by the applicable laws of the Menominee Indian Tribe of Wisconsin and, where not preempted or displaced by tribal law, the laws of the State of Wisconsin and the United States, without regard to conflict-of-law principles.

16.A. Mandatory Good-Faith Mediation

Before initiating any lawsuit, arbitration, or other formal proceeding, the parties agree to first attempt to resolve any dispute, claim, or controversy arising out of or related to these Terms, your purchase, or your use of the Services through good-faith mediation.

The party seeking relief shall send a written Notice of Dispute to cwilber79@gmail.com describing (1) the nature of the dispute, (2) the specific relief sought, and (3) the sender's contact information. Within thirty (30) days of the Notice of Dispute, the parties shall meet — in person, by phone, or by video conference — and make a good-faith effort to resolve the dispute.

If the parties cannot resolve the dispute within thirty (30) days of the Notice of Dispute, either party may proceed to file a claim in accordance with Section 16.B. Neither party may file suit until this mediation step has been completed or the 30-day period has expired. Any statute of limitations shall be tolled during this mediation period.

Mediation costs, if any, shall be shared equally by the parties, unless the parties agree otherwise or applicable tribal law provides a different allocation.

16.B. Venue and Jurisdiction

If mediation does not resolve the dispute, any lawsuit, claim, or controversy shall be brought exclusively in the Menominee Tribal Court, located in Keshena, Wisconsin, and you consent to the personal jurisdiction of that court. In the event the Menominee Tribal Court declines jurisdiction over a particular dispute, or a dispute is one over which the Tribal Court has no authority, the dispute shall be resolved in the state or federal courts serving the Menominee Indian Reservation, and you consent to the personal jurisdiction of those courts.

By purchasing from or using ThunderBird Media, you expressly waive any objection to the jurisdiction of the Menominee Tribal Court based on lack of personal jurisdiction, improper venue, forum non conveniens, or your non-membership in the Menominee Indian Tribe.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms, together with our Refund Policy, Shipping Policy, Privacy Policy, and Legal Notice, constitute the entire agreement between you and ThunderBird Media regarding the Services and supersede any prior agreements.
